Terms of Service: The Rules of Our Peer-to-Peer Logistics Marketplace

Welcome to CargoDelivery. Please read these Terms of Service carefully before you access or use our website, dashboard, or any related features. These CargoDelivery terms of service form a legally binding agreement between you and the platform administration. By browsing our listings, creating a profile, publishing an advertisement, or otherwise using our peer-to-peer (P2P) marketplace in any way, you confirm that you have read, understood, and agreed to be bound by every condition set out below. If you do not accept these terms in full, you must stop using the platform immediately.

Our goal with this document is to be completely transparent about what CargoDelivery is, what it is not, and where responsibility begins and ends for every party that uses it. The language here is intentionally clear so that both private shippers and independent drivers understand the strictly informational role that our classified dashboard plays in connecting them.

Terms of Service: The Nature of Our Classified Service

The CargoDelivery terms of service govern your access to and use of our platform. CargoDelivery operates strictly as an online information bulletin board—a classifieds marketplace—that connects independent drivers and carriers with individual or business clients who require cargo transportation services. In essence, the platform is a digital notice board: it displays offers and requests and allows interested parties to find one another. Nothing more, and nothing less.

When a client finds a suitable listing, the platform simply makes it possible for that client to contact the driver directly. Every meaningful step after that first contact—negotiation, scheduling, pricing, loading, transport, delivery, and payment—happens entirely between the two parties, away from CargoDelivery. We provide the neutral space where supply meets demand; we do not step into the arrangement that follows.

It may help to think of CargoDelivery the way you would think of a printed classifieds page in a newspaper. The publisher prints the advertisements and makes them available to readers, but the publisher does not sell the goods, deliver them, collect payment, or vouch for the honesty of the advertiser. Our role online is the same. This model keeps the service simple, free, and neutral, but it also means the responsibility for a successful, safe, and lawful transport sits squarely with the users who arrange it—never with the platform that introduced them.

Critical Disclaimer: CargoDelivery is not a transport company, freight forwarder, broker, or logistics agent. We do not own, manage, or operate any vehicles, nor do we employ, contract, or manage any drivers who post listings on this website.

This distinction is fundamental to understanding your rights and responsibilities. Because we are only a publisher of classified advertisements, we do not organise routes, assign shipments, dispatch vehicles, or take part in the physical movement of any goods. Any impression—created by a listing, a message, or a third party—that CargoDelivery itself carries, handles, stores, or guarantees the transport of cargo is incorrect and should not be relied upon. The drivers and carriers you find here are independent operators acting entirely on their own account.

Definitions Used Throughout These Terms of Service

To avoid any confusion, the following terms carry a specific meaning wherever they appear in this agreement:

  • Platform / Website — CargoDelivery, including all of its pages, subdomains, and features accessible online.
  • Administration — the web-developer organisation that owns, operates, and maintains the CargoDelivery website.
  • User — any person or organisation that accesses the platform, whether or not they have registered a profile.
  • Driver / Carrier — an independent individual or business that publishes a listing offering cargo transportation services.
  • Client / Shipper — an individual or business that seeks transportation services and contacts a driver through a listing.
  • Listing / Advertisement — any classified post published by a user on the platform.

These definitions apply consistently across the entire CargoDelivery terms of service, including all headings, sub-sections, and disclaimers.

Eligibility and Account Registration

To publish a listing or contact other users, you may be required to register a profile. By creating an account you confirm that you are legally capable of entering into binding agreements in your jurisdiction and that all the information you provide is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your login credentials and for every activity that occurs under your account.

You agree to notify the administration promptly if you suspect any unauthorised use of your profile. The administration is not responsible for any loss arising from your failure to safeguard your account details. Registering under a false identity, impersonating another person or business, or maintaining multiple accounts for deceptive purposes is prohibited and may result in immediate removal from the platform.

Terms of Service: Financial Independence and Direct Agreements

All interaction between users on CargoDelivery is direct. The platform deliberately stays out of the commercial relationship between clients and drivers. Please be aware of the following conditions, which apply without exception:

  • Our platform does not handle, process, hold, or escrow any financial transactions between clients and drivers.
  • We do not set, regulate, recommend, or specify transport prices, shipping rates, surcharges, or fees anywhere on the website.
  • All financial agreements, payment terms, deposits, refunds, and price negotiations are conducted exclusively and directly between the driver and the client, outside of the CargoDelivery platform.

Payments Are Strictly Between Users

Because no money ever passes through CargoDelivery, the platform cannot issue invoices, receipts, refunds, or chargebacks, and it has no ability to reverse, freeze, or recover any payment. Users must agree between themselves on the method, timing, and currency of payment, and they bear full responsibility for the security of whatever payment channel they choose. We strongly encourage both parties to put their commercial terms in writing before any transport begins, so that expectations are clear and disputes are easier to avoid.

Independent Pricing

Every price shown in a listing is set solely by the driver who published it. CargoDelivery neither reviews nor endorses these figures. If a quoted price seems unusually low or high, users should treat that as a signal to ask questions and compare listings, not as a value confirmed by the administration.

Terms of Service: Complete Limitation of Liability

Because CargoDelivery serves purely as a digital notice board, the administration holds zero liability regarding the execution of transport requests. By using the platform you acknowledge and accept that any transportation arrangement you enter into is undertaken entirely at your own risk. The sections below describe the boundaries of this limitation in more detail.

Transport and Vehicle Security

We do not inspect, verify, or monitor the technical condition, safety, roadworthiness, insurance status, or legal compliance of any vehicles operated by carriers listing on our platform. We do not check licence plates, maintenance records, or driving histories. It is the responsibility of the client to satisfy themselves that a chosen carrier and vehicle are suitable for the cargo in question, and it is the responsibility of the driver to ensure that their vehicle is lawful, insured, and fit for the road.

Cargo Loss and Damage

CargoDelivery bears no responsibility and shall not be held liable for any loss, theft, damage, destruction, contamination, spoilage, or delayed delivery of any goods, packages, or cargo transported through connections made on this website. Any claim relating to the condition or whereabouts of transported goods must be pursued directly against the carrier and, where appropriate, through the carrier's own insurance or the competent authorities. Clients are strongly advised to arrange their own cargo insurance and to document the condition and value of their goods before handover.

Failure to Perform

We do not guarantee that any driver or client will fulfil their agreed-upon obligations. Any disputes regarding incomplete trips, no-shows, cancellations, late arrivals, or broken promises must be resolved directly between the participating parties, without the involvement of CargoDelivery. The platform will not mediate, arbitrate, or take sides in such disputes, and it accepts no liability for losses arising from another user's conduct.

Indemnification

You agree to indemnify and hold harmless the administration, its operators, and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal costs) arising out of your use of the platform, your listings, your dealings with other users, or your breach of these terms. This obligation survives the deletion of your account.

In short: the value CargoDelivery provides is visibility and connection. The responsibility for the transport itself—its safety, its completion, and its payment—always rests with the driver and the client who agree to work together.

User Verification Disclaimer

While the administration may provide options for manual document verification (badge checks) to confirm the identity of registered profiles, this process is for informational purposes only. It exists to add a layer of transparency to the marketplace, not to certify quality. A verified profile status does not constitute an endorsement, insurance policy, warranty, or guarantee of a driver's reliability, professional skills, financial stability, or honesty by CargoDelivery.

Verification confirms only that certain documents were presented at a given point in time. It does not confirm that those documents remain valid, that the driver continues to hold the necessary permits, or that the driver will behave professionally. Users should always carry out their own due diligence—checking references, reviewing communication carefully, and confirming credentials independently—before entrusting any cargo to a carrier.

Terms of Service: Acceptable Use Policy

To keep CargoDelivery useful and lawful for everyone, all users must follow this acceptable use policy. Users are prohibited from publishing, requesting, or arranging the transport of illegal, dangerous, prohibited, restricted, or hazardous materials. This includes, without limitation, weapons, explosives, controlled substances, counterfeit goods, protected wildlife, and any item whose movement is forbidden or restricted under applicable law.

Drivers must hold the valid commercial licences, permits, and authorisations required by the regional and national laws under which they operate, including any documentation needed for cross-border transport. Compliance with import, export, and customs requirements is entirely the responsibility of the users involved. If your shipment crosses a border, you should familiarise yourself in advance with the applicable procedures—a helpful starting point is our overview of the relevant customs rules, which explains common documentation and declaration obligations. For the definitive and current position, always consult the official guidance published by the European Commission's customs authorities or your local customs office.

Responsibilities are shared, but they are also distinct. The summary below sets out what each side of a transport arrangement is expected to do:

For Private Shippers

Describe your cargo honestly, package it properly, declare its value and contents accurately, and confirm that the goods are legal to send. Carry out your own checks on any driver before handover, and arrange insurance where appropriate.

For Independent Drivers

Hold the correct licences, permits, and insurance, keep your vehicle roadworthy and compliant, publish accurate listings, and honour the terms you agree directly with each client. You transport goods on your own account and at your own risk.

In addition, users agree not to post false, misleading, or fraudulent listings; harass, threaten, or defame other users; distribute spam or malware; scrape or harvest platform data through automated means; or circumvent, disable, or interfere with any security feature of the website.

CargoDelivery reserves the right, at its sole discretion and without prior notice, to remove any listing, suspend or ban any user account, and report activity to the appropriate authorities where it violates these terms or engages in fraudulent behaviour. This right is exercised to protect the integrity of the marketplace and the safety of its users, and its use does not create any duty on the part of the administration to monitor content proactively.

Intellectual Property

The CargoDelivery name, logo, website design, layout, and all original text and graphics are the property of the administration and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the platform without prior written permission, except for the personal, non-commercial use inherent in browsing and posting listings.

When you publish a listing, you retain ownership of the content you submit, but you grant the administration a non-exclusive, royalty-free licence to display, store, and distribute that content on the platform for the purpose of operating the marketplace. You are responsible for ensuring that anything you post does not infringe the rights of any third party.

Third-Party Links and Content

The platform may contain links to third-party websites or reference services operated by others. These links are provided for convenience only. CargoDelivery does not control, endorse, or assume any responsibility for the content, privacy practices, or reliability of any third-party site. Accessing such sites is done entirely at your own risk, and you should review the terms and privacy policies of any external service you choose to use.

Dispute Resolution Between Users

Since every transport arrangement is a direct agreement between a driver and a client, any disagreement that arises from that arrangement is a matter strictly between those two parties. We encourage users to resolve disputes amicably and in good faith, keeping written records of what was agreed. Where a dispute cannot be settled privately, the affected parties may pursue whatever legal or regulatory remedies are available to them under the applicable law. CargoDelivery is not a party to these disputes and will not be named as a mediator, guarantor, or respondent in them.

Privacy and Data

Your use of CargoDelivery is also governed by our Privacy Policy, which describes how limited personal information is collected and used to operate the classifieds service. By using the platform you consent to that processing. Because contact between users happens directly, you should share only the information necessary to arrange transport, and you should treat other users' personal details with the same care you would expect for your own.

Changes to These Terms of Service

We reserve the right to modify, update, or replace these CargoDelivery terms of service at any time and for any reason, including to reflect changes in the law or in the way the platform operates. When we make material changes, we will update the "last updated" date shown below. Your continued use of the marketplace following any updates signifies your agreement to the revised terms. We recommend reviewing this page periodically so that you always understand the conditions that apply to your use of the platform.

General Provisions

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right. These terms constitute the entire agreement between you and the administration concerning your use of the platform, and they supersede any prior understandings.
